Terms of service
These Terms of Service govern access to and use of the website maisalya.com (the "Site"), published by Maisalya, a sole trader, 60 rue François 1er, 75008 Paris, France — SIREN 934 307 075 — contact@maisalya.com.
1. Acceptance. By accessing the Site and/or placing an order, you acknowledge that you have read these Terms of Service as well as our Terms & Conditions of Sale, and that you accept them without reservation. If you do not accept these terms, please do not use the Site.
2. Access to the Site. The Site is accessible 24 hours a day, 7 days a week, except in the event of scheduled or unscheduled interruption for maintenance or force majeure. Maisalya has an obligation of means and cannot be held liable for any temporary unavailability of the Site.
3. Products. The Site offers dietary supplements (gummies). Our products are not medicines: they are not a substitute for a varied and balanced diet or a healthy lifestyle. They are intended for adults only. If you are undergoing medical treatment, pregnant or breastfeeding, please seek advice from a healthcare professional. Keep out of reach of children.
4. Account and information. You agree to provide accurate, complete and up-to-date information when placing any order, and not to impersonate any third party.
5. Use of the Site. You agree to use the Site fairly, not to disrupt its operation, not to attempt unauthorised access to its systems, and not to use it for unlawful purposes.
6. Intellectual property. All elements of the Site (text, images, logo, graphics, videos) are protected and remain the exclusive property of Maisalya. Any reproduction without prior written authorisation is prohibited.
7. Prices and orders. Prices are shown in euros, inclusive of all taxes. Terms relating to ordering, payment, delivery, withdrawal and warranties are set out in our Terms & Conditions of Sale, our Shipping Policy and our Return & Refund Policy.
8. Liability. Maisalya cannot be held liable for any indirect damages resulting from use of the Site. Maisalya accepts no responsibility for external links featured on the Site.
9. Personal data. The processing of your data is described in our Privacy Policy. You have the right to access, rectify, erase and object to the processing of your data, which you may exercise via contact@maisalya.com.
10. Mediation and disputes. In accordance with Articles L.612-1 et seq. of the French Consumer Code, you may make free use of a consumer mediator. You may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
11. Governing law. These Terms of Service are governed by French law. In the absence of an amicable resolution, the French courts shall have jurisdiction.
